introduction
All talents introduced by the Agency (Migdal Management) to a client must be booked through Migdal Management for any future work related to the first booking.
CONFIRMATION
All fees are to be negotiated with Migdal Management exclusively.
SHOOT FEES
Shoot fees, also known as Basic studio fees (bsf), are charged by the day (Equity contracts excluded) unless otherwise agreed. All fees are based on the following –
Photo Shoots:
A full day is 8 hours
A half-day is 4 hours
TV / Moving Image shoots:
A full day is 10 hours
All rates include an hour taken for lunch
OVERTIME
The booking will be charged from the time specified by the client for the talent's arrival. If the shoot runs over the time agreed, an overtime rate will apply at 50% of the hourly negotiated rate per hour.
if no rate per hour is agreed prior to the booking, overtime will be charged at 20% of the basic studio fee, per each hour of overtime.
TRAVEL
Travel-days (for work overseas) are charged at 50% of the basic studio fee, subject to confirmation upon booking. the fee may be adjusted based on the overall duration of travel. If in the event of UNFORESEEN delays a travel-day extends to the following working day, an additional travel-day fee will be charged as standard.
Travel to and from talent's home to nearest UK airport will be charged at £120, unless travel arrangements are made by the production company directly.
Cabs will be provided by the client for any job that falls outside of a time that enables talent to travel home by public transport.
EXPENSES
In the event that a talent is required to make their own way to or from a production location, travel expenses will be charged at a standard economy rate, unless otherwise agreed.
FITTINGs/rehearsals/RECALLS/MEALS
Fitting Fees are charged at 50% of the basic studio fee, unless otherwise specified on the casting brief or at the time of booking.
fitting sessions should not exceed two hours, unless otherwise specified on the casting brief or at the time of booking.
rehearsal Fees are charged at 50% of the basic studio fee, unless otherwise specified on the casting brief or at the time of booking.
Recall Fees are charged at £50, unless otherwise specified on the casting brief or at the time of booking.
if Meals are not provided by the Company a Per Diem of £50 per day will be paid on arrival, unless otherwise specified on the casting brief or at the time of booking.
covid-19
Covid test days are charged at 50% of the basic studio fee, unless otherwise specified on the casting brief or at the time of booking. This charge does not apply if a test is conducted at the talent’s home address.
Covid back-up roles in which the talent is required on set are charged as standard (Basic Studio Fee, Recall, Fittings, Travel Fees etc) minus the Usage Fee. Covid back-up roles in which the talent is required to be on stand-by are subject to negotiation.
Usage Fees do not apply to Covid back-up roles so long as the talent is not used on set. In the event that a Covid back-up role is upgraded to a primary role, the Usage Fee specified on the casting brief will come into effect.
IMAGE USAGE
The standard use covers the right to use the image in the UK only for up to 1 year unless otherwise agreed in writing.
IF A TALENT IS BOOKED FOR A ‘WALK-ON’ ROLE, THEY SHOULD BE UNRECOGNISABLE IN THE FINAL EDIT UNLESS OTHERWISE AGREED IN WRITING. IN THE CASE THAT THE TALENT BECOMES RECOGNISABLE IN THE FINAL EDIT, MIGDAL MANAGEMENT RESERVES THE RIGHT TO NEGOTIATE A RATE REASONABLE TO THE ROLE AND OVERALL USAGE.
In THE CASE THAT OTHER TALENTS FROM DIFFERENT AGENCIES ARE BOOKED FOR COMPARABLE ROLES ON THE SAME JOB BUT ARE BEING PAID AT A HIGHER RATE, Migdal Management reserves the right to negotiate that same rate and be informed by the client of this rate (Unless it is specified within the different roles) This also applies for any additional usage that might be bought out after the first airing.
When basic studio fee and usage fee are combined as one fee at the time of booking, the full fee is payable whether or not the useage is appropriated.
The proposed initial media, territory and length / period of usage of all still or moving images MUST be negotiated prior to the booking. If usage requirements change, the Client should contact Migdal Management immediately and additional usage fees will be negotiated.
The photographer is NOT entitled to use any of the images he or she takes for any other usage than his or her personal portfolio beyond that agreed, negotiated and paid for through Migdal Management.
ADDITIONAL USAGE
‘options’ to extend usage terms will include a 10% increase on each consecutive period, as standard.
It is the Clients responsibility to notify Migdal Management of any further usage and to negotiate additional fees. Migdal Management reserves the right to quote the Client at a rate that it deems reasonable if extra usage / additional fees are not negotiated prior to any booking.
Video/Commercials
Additional fees are payable for the right to use the footage in any way whatsoever other than the initial agreed usage detailed on the booking confirmation. Unless otherwise agreed, TV commercial usage will be charged as per the rates calculated on www.usefee.tv.
EXCLUSION FEES / CONFLICTING WORK
It is the client's responsibility to check with the talent whether conflicting work has been done prior to booking
If a talent advertises a product, he/she is able to work for any competitor unless an exclusion fee is negotiated.
PROVISIONAL BOOKINGS OR “PENCILS”
Provisional bookings will be automatically cancelled if they are not confirmed within 24 hours of the proposed booking, or if a definite booking is offered and the provisional cannot be confirmed.
CANCELLATION FEES
If a booking is cancelled within 24 HOURS of the starting time (be it travel day or shoot day), the full fee will be charged unless the same talent is re-booked for another date within 24 hours, in which case half the fee will be charged.
If a booking is cancelled outright outside the 24-hour period but within five working days of the starting time, 50% of the fee will be charged.
WEATHER DAYS
At the first cancellation, a half fee is charged unless the client fails to cancel in time to prevent the talent's attendance, when the full fee is payable. At the second cancellation the full fee is charged.
PAYMENT
Payment terms are strictly 30 days within the invoice date, unless agreed otherwise. In the event of late payment, Migdal Management reserves the right to claim interest on unpaid invoices at the statutory 8% over the Bank of England base rate, as specified by UK law.
* Please note no use of any images is permitted until all relevant fees have been paid.
All fees are for the right to use pictures or footage and, once agreed, are payable whether or not the use is appropriated.
If fees are invoiced to a client with an address outside the UK, the client must cover any bank charges charged by the client’s bank outside the UK and Santander bank in the UK. The full amount stated on the invoice must be credited to the Migdal Management bank account without alterations due to exchange rates.
INSURANCE
The client will maintain adequate insurance cover to underwrite its obligations to the talent.
It is the client’s responsibility to arrange insurance if indemnity is required against a talent's inability to attend through sickness or unforeseen circumstances.
The client is responsible for the talent health and safety when the talent is travelling, or providing services in connection with the booking to the same extent as if the talent were an employee of the client.
We reserve the right to negotiate within the structure of these terms and conditions.
